SAP Q1 Looking Good, Oracle Lawsuit Looking Silly

With SAPPHIRE + ASUG upon us, the timing and tenor of SAP's Q1 earnings could not be better. No matter how you slice it, SAP Q1 numbers look good.

Improved sales helped boost quarterly profit nearly 10% as net income jumped to $413 M, up from $282 M a year ago. Total revenue jumped 6% to $295 B.

SAP continued to gain worldwide market share among core enterprise application vendors, with software and software-related service revenues increasing 25.1% for the four quarter period ending March 31, 2007 compared to 24.5% for the four quarter period ending December 31, 2006.

Of equal interest is SAP's deft handling of the pesky Oracle lawsuit during its Q1 Earnings conference call.

Apotheker's refusal to directly name Oracle while commenting on SAP winning competitive deals speaks volumes on how SAP compares the company's high ethics, integrity and trustworthiness to (and we're editorializing here) Oracle's utter lack thereof:

We won 78% in the first quarter against our next largest competitor. This demonstrates the superiority of our products, our technology and our people, and the strong acceptance of the transparent product roadmap and vision we continue to provide to our customers. Our customers are making a very clear choice on who they trust as their software solution partner.

SAP CEO Henning Kagermann broke a bit from the minimalist 'SAP will vigorously defend itself' corporate response to Oracle's charges, defending TomorrowNow and accusing Oracle of trying to limit customer choice:

SAP and TomorrowNow are actively engaged in legitimate competition [...] TomorrowNow's business success is all about customer choice. This lawsuit demonstrates that Oracle is trying to limit customer choices by trying to discredit the competition.

Bill McDermott, president and CEO of SAP Americas Inc., was a bit more emphatic (and a wee bit threatening) in his delivery of the standard SAP response to the Oracle lawsuit: 

We have a great brand. We respect other people's intellectual property, and we expect them to respect our intellectual property. We are a good partner, and our reputation is rock-solid. And we will, in the coming days, vigorously respond to this allegation, and the strength of our response will be clear and decisive.
